Welcome to SkillMark Academy! These Terms of Use ("Terms") govern your use of our website, courses, and other products and services ("Services"), provided by SkillMark Academy, a subsidiary of EduVibe Solutions ("we," "us," or "our"). Please read these Terms carefully.

By creating an account or using our Services, you agree to be bound by these Terms, including the policies referenced within them.

You may use our Services only if you can form a binding contract with us and only in compliance with these Terms and all applicable laws. When you create your SkillMark Academy account, you must provide us with accurate and complete information, and you agree to keep this information up-to-date.

Any use or access by anyone under the age of 13 is strictly prohibited.

Our License to You

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use our Services for your personal, non-commercial use. You agree that you will create and use only one user account and will not share access to your account with any third party. Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access.

SkillMark Academy offers courses and content from industry experts. While we strive for excellence, we reserve the right to cancel, interrupt, reschedule, or modify any course content or assessment.

No Academic Credit

Participation in or completion of a course does not grant any academic credit from a formal institution. SkillMark Academy and its partners are not an accredited university, and our certificates serve as a testament to your skills and completion, not as a formal academic credential.

Our Services may enable you to share your content, such as quiz results, projects, assignments, and reviews ("User Content"). You retain all intellectual property rights in, and are responsible for, the User Content you create and share.

To the extent that you provide User Content, you grant SkillMark Academy a fully-transferable, royalty-free, perpetual, non-exclusive, worldwide license to copy, distribute, modify, and otherwise use your User Content in connection with providing the Services.

We offer paid Services for a fee. You are responsible for paying all fees and applicable taxes in a timely manner. All payments are processed through our third-party payment processor, Razorpay, under the name EduVibe Solutions.

Refund Policy

If you cancel your one-time, paid enrollment for a course, we will offer you a complete refund until 14 days after payment, or until you earn a course certificate, whichever is earlier. To request a refund, please contact our support team at contact@skillmarkacademy.com.

We have no obligation to offer refunds to users who violate these Terms or our Code of Conduct, even if the request is made within the designated refund period. Similarly, we have no obligation to offer late refunds to users who are unsatisfied with their final grade or fail to complete a course.

You agree that you are responsible for your own use of the Services and for your User Content. You agree that you will use the Services in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

You are prohibited from using our Services to share content that is illegal, harasses others, violates intellectual property rights, or is otherwise malicious or inappropriate. You are not allowed to share your password, access another user's account, or do anything that might put your account at risk.

To the maximum extent permitted by law, SkillMark Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. In no event shall our aggregate liability for all claims related to the Services exceed the total amount of fees received by us from you for the use of paid Services during the past six months.

These Terms will be governed by the laws of the State of Maharashtra, India, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
